Limited Warranty

Deltec, Inc. (the “Manufacturer”) warrants to the Original end-user

Purchaser that the Deltec Cozmo

™

Insulin Pump (the “Pump”), ex-

cluding accessories, shall be free from defects in materials and work-

manship under normal use, if used in accordance with this User’s

Manual, for a period of four (4) years from the date of purchase by

the Original end-user Purchaser. This warranty does not cover nor-

mal wear and tear or maintenance and specifically excludes all acces-

sories, including, but not limited to batteries, infusion sets, cartridges,

apparel, equipment, computers and printers used with the Pump.

Limitation of Remedies

The Manufacturer will replace without charge (except for postage and

handling) any Pump (excluding all accessories) which is determined

by the Manufacturer to be defective during the four (4) year warranty

period. The replacement Pump which the Original end-user Purchaser

receives under this warranty may be a refurbished Pump. If the Origi-

nal Purchaser requires that the original Pump be repaired and re-

turned, this must be requested to the Manufacturer at the time of

reporting the warranty defect. In the event the Pump is replaced or

repaired, the warranty period will not extend beyond the original

warranty period. THIS IS THE EXCLUSIVE REMEDY.

Parties Covered:

This Warranty extends only to the Original end-user Purchaser of the

Pump. This Limited Warranty does not extend to subsequent pur-

chasers. The Original end-user Purchaser should retain the invoice

or sales receipt as proof of the actual date of purchase by the Original

end-user Purchaser.

Conditions of Warranty:

This warranty is valid only if the Pump is used in accordance with

this User’s Manual. The warranty will be void in the following cases:

1. The Pump has been altered, misused (misuse includes, but is

not limited to use not in accordance with this User’s Manual, used

with accessories not approved by the Manufacturer and/or used

with a computer program other than that licensed by the Manufac-

turer) or damaged by neglect or accident;

2. The Pump has not been properly maintained or repaired by

persons not authorized by the Manufacturer; or

3. The Pump serial number has been removed or damaged.

Exclusions:

All other warranties, express or implied, are excluded, including but

not limited to the warranties of merchantability and fitness for a par-

ticular purpose or use. The remedies provided in this Warranty are

the exclusive remedies available to the Original end-user Purchaser

for any breach of this Warranty and no person has the authority to

bind the Manufacturer to any representation, condition or warranty

except this Warranty.

The Pump can only be used under the supervision of medical per-

sonnel whose skill and judgment determine the suitability of the Pump

for a particular medical treatment and patient.

The Manufacturer, its distributors nor suppliers shall not be respon-
